TORONTO — An agreement has been reached in the legal dispute between Metrolinx, Infrastructure Ontario (IO) and Crosslinx Transit Solutions (CTS) over the Eglinton Crosstown Light Rail Transit (LRT) project.
The parties recently agreed to a revised production schedule and accountabilities to ensure the project is delivered on time, stated a release issued by Metrolinx CEO Phil Verster.
“Metrolinx, IO and CTS have been working closely over the last several months to resolve the schedule and production issues that CTS has experienced on the project,” said Verster. “An agreement has been reached that fairly addresses the challenges that CTS has encountered. While details are commercially confidential, the agreement has been achieved within the scope and budget for the project, with no additional costs to the taxpayers in the Province of Ontario.”
CTS, the consortium undertaking the build, issued a Notice of Action in July for breach of contract and Metrolinx responded in August by filing an application to stay any claim by CTS for its delays related to construction and delivery of the $5.3-billion LRT project by September 2021. A hearing was set for the Metrolinx application on Sept. 11 but with the agreement in place CTS agreed to stay the legal proceedings, indicates Verster, adding once the agreement is fully implemented, the action will be dismissed.
“Metrolinx and IO will continue to work in partnership to support CTS to complete their work program in line with the contracted schedule,” the statement notes. “With three years remaining, CTS has the ability to complete the construction and meet the in-service date.”
Requests for comment to CTS were not returned as of deadline.
