Lawsuit launched by Mosaic Transit Group on Finch West LRT

TORONTO — Mosaic Transit Group has filed a lawsuit over the Finch West LRT.

According to media reports, the lawsuit filed in August indicates Metrolinx, the TTC and the City of Toronto breached contractual obligations and the construction agreement on the project.

“We are working hard to support Metrolinx and the Government of Ontario to ensure that all parties can get this important TTC-operated LRT line open to the public as soon as possible,” a spokesperson from Mosaic Transit Group, the consortium building the LRT, stated in an email to the Daily Commercial News.

 “Mosaic has not stopped working. We continue to work without interruption despite the matters in court. To be clear, our people have worked tirelessly and have achieved successful completion of construction, as recently celebrated by the Minster of Transportation. Now, we need Metrolinx to get the TTC to do its part. We stand ready to work with the government to get this line open for the residents along the Finch West LRT line.”

In September, the province announced all 18 stations and stops across the 11-kilometre Finch West LRT project are officially complete. The line will run along Finch Avenue West from Keele Street to Highway 27, where it will turn and travel south to the Humber College north campus.

“Our message to Mosaic is clear, get out of court and back to work,” said a Metrolinx spokesperson in an email. “We are working closely with Mosaic to get passengers on the Finch West LRT at the soonest possible date. The CEOs of Metrolinx, Mosaic and its partner companies meet several times per month to work through challenges or problems that may come up in the delivery of this project. This is above and beyond the daily working relationship that exists among our technical teams. We are on the ground with them and close to this project.”

The email stated Mosaic has signalled liquidity issues and Metrolinx offered financial support to sufficiently complete the project.

“Mosaic has been unable to reach internal agreement on this offer,” reads the email. “Mosaic’s recent loss of six weeks of schedule due to poor work planning and poor project management is unacceptable. It is time to complete the work necessary to start TTC driver training and get the line ready for opening.”
