Director ordered to pay $5,000 for Environmental Protection Act Violation

TORONTO — Martin Hackborn has been convicted of one violation under the Environmental Protection Act (EPA) and fined $5,000, for failing to comply with a director’s order by failing to remove all waste from a site using an authorized waste hauler.

Hackborn is a director of 2366352 Ontario Ltd., which operates as Deerfield Excavating and Trucking.

The company was convicted June 7 and fined $5,000 plus a victim fine surcharge of $1,250 and given six months to pay.

In July 2020, the ministry issued an order to Hackborn and the company, requiring the removal of waste materials that had been deposited at a site in North Dumfries.

The deposited waste materials at the site were identified as foundry sand wastes, a byproduct residue created from industrial processes that typically contain soluble chemicals and other chemical binders, indicates a court bulletin.

Following a request for ministry review of the order, a director’s order was issued to Hackborn and the company in August 2020, requiring Hackborn to remove all waste from the site using an authorized waste hauler by September 2020.

Between April 2022 and April 2023, the ministry confirmed the waste materials were still present at the site and had not been removed by a licensed waste hauler, adds the bulletin.

The ministry’s Environmental Investigations and Enforcement Branch investigated and laid charges which resulted in the conviction.
