TOGETHER WITH rights of way or rights in the nature of easements, in favour of the owners, their successors and assigns of the Condominium Lands in, over, along and upon that part of Block 9, Plan 20M-1211 designated as Parts 1 to 32, both inclusive and Parts 37 to 64, both inclusive, on Plan 20R-21915 for the access of persons, materials, vehicles and equipment necessary for the maintenance, repair, reconstruction and operation of any utility or service, and mechanical or electrical installations appurtenant thereto, including but not limited to water mains, gas mains, storm or sanitary sewers, electrical cables, wires and ducts, telephone and cable television, cables, wires, ducts and street light standards, retaining walls, acoustic fences, catch basins, manholes, fire hydrants and hydro vaults all of which are situate or to be situate within that part of Block 9, Plan 20M-1211 designated as Parts 1 to 32, both inclusive and Parts 37 to 64, both inclusive, on Plan 20R-21915 and which are the responsibility of the Condominium Corporation to maintain and repair pursuant to the Declaration to which this Schedule “A” is attached.
TOGETHER with a non-exclusive easement in favour of the Condominium Lands for vehicular and pedestrian ingress and egress over Part of Block 8, Plan 20M-1211, designated as Parts 1, 2, 3 and 4 on Plan 20R-22115, provided that until such time that the condominium corporation registered within the Condominium Lands obtains a conveyance of two visitor parking units in the underground garage constructed or to be constructed in the condominium corporation registered within Block 9, Plan 20M-1211 (the “Block 9 Visitor Parking Units”), the owners of the Condominium Lands shall have a non-exclusive easement over Parts 3 and 4, Plan 20R-22115 for the purposes of visitor parking, which easement for visitor parking shall, as provided, be at end and deemed to be abandoned at such time that the Block 9 Visitor Parking Units are conveyed to the condominium corporation registered within the Condominium Lands.
TOGETHER with a temporary easement in favour of the Condominium Lands for vehicular ingress and egress over Part of Block 8, Plan 20M-1211, designated as Part 5 on Plan 20R-22115 until such time that the Block 9 Visitor Parking Units are conveyed to the condominium corporation registered within the Condominium Lands, which easement for vehicular access shall be at end and deemed to be abandoned at such time that the Block 9 Visitor Parking Units are conveyed to the condominium corporation registered within the Condominium Lands.
SUBJECT TO an easement for entry in favour of Dundas-Trafalgar Inc. over the Condominium Lands as set out in Instrument No. HR1599556.
SUBJECT TO an easement in gross in favour of Oakville Hydro Electricity Distribution Inc. over the Condominium Lands as set out in Instrument No. HR1812312.
SUBJECT TO an easement in gross in favour of Cogeco Connexion Inc. over the Condominium Lands as set out in Instrument No. HR1836298.
SUBJECT TO an easement in favour of Bell Canada over the Condominium Lands as set out in Instrument No. HR1841791.
RESERVING an easement in favour of the owners of Block 8, Plan 20M-1211 over the Part of Block 9, Plan 20M-1211, designated as Part 1 on Plan 20R-22141 for the purpose of providing pedestrian ingress and egress over the walkways located therein.
RESERVING an easement in favour of the owners of Block 8, Plan 20M-1211 over the Condominium Lands to permit the free, unimpeded and unobstructed passage of an overhead crane swing to facilitate the construction, repair and maintenance of buildings and appurtenant services to be constructed.
