Constructor fined $85,000 after worker fatally injured while cutting down tree

CHATHAM, ONT. — A Chatham, Ont. company that specializes in concrete foundations has been fined after a worker was killed cutting down a tree on a project near 354 Gould Rd. in the Township of Dawn-Euphemia.

John Harris Concrete Ltd. was fined $85,000 and convicted on Jan. 13 by Justice of the Peace Susan Whelan in Provincial Offences Court in Sarnia.

According to an Ontario court bulletin, on Oct. 26, 2022, one of the company’s five workers was clearing brush and felling trees from the area around a drainage ditch when they were fatally injured by a tree.

An investigation by the Ministry of Labour, Immigration, Training and Skills Development found while the worker had been trained to operate a chainsaw safely, they were not trained on tree felling.

As a result, John Harris Concrete Ltd. failed, as an employer, to provide training on how to safety fell trees to the worker, as required by section 25(2)(a) of the Occupational Health and Safety Act.
