Fleten Masonry Ltd., a Mississauga-based masonry company, was fined $60,000 last week for a violation of the Occupational Health and Safety Act (OHSA) that resulted in serious injuries to an employee.

Court heard that on Aug. 13, 2003, a worker was attempting to retrieve a scaffold plank when he fell about 7.85 metres from a beam in a turbine pit area of an old mill building in Centre Wellington. The worker suffered multiple injuries, including fractures to the jaw, wrist, hand and pelvis.
The worker had been directed to retrieve scaffold planks for use on another scaffold. However, one of the planks made an unexpected bounce when it was pulled off a masonry wall and it struck another plank below. The other end of the plank hit the worker’s leg and, as a result of the impact, the worker lost balance and fell.
Fergus Mill Inc. had contracted Fleten Masonry to do masonry work on the project.
Fleten Masonry was found guilty, as an employer, of failing to ensure that a worker used fall protection.
