P.E.I. contractor fined for practicing engineering without license

A contractor in Prince Edward Island has been fined in Charlottetown provincial court for practicing engineering without a license during the construction of a hotel in Montague, P.E.I.

A contractor in Prince Edward Island has been fined in Charlottetown provincial court for practicing engineering without a license during the construction of a hotel in Montague, P.E.I.

According to the Association of Professional Engineers in P.E.I., Southern Kings Construction Ltd. was the general contractor responsible for the design and construction of The Riverhouse Inn.

The $2.3 million project is a four-storey hotel with thirty guest rooms.

A complaint was received by the association about the services being provided by the contractor on this project. After a full investigation by the association charges were filed in provincial court.

As a result, Kevan MacLean, the owner of Southern Kings Construction Ltd, pled guilty to practicing engineering without holding a certificate of authorization from the Association of Professional Engineers of PEI.

Chief Judge John Douglas imposed a fine of $2,500, under the Engineering Profession Act.

The Riverhouse Inn was opened to the public on Jan. 17, 2014.

The Engineering Profession Act requires that any person or company practicing engineering in PEI to be properly licensed by the Association. First offences can result in fines of up to $5,000.

The Association is responsible for investigating complaints under the Act and prosecuting offending individuals and corporations.

Certain engineering works and services were completed by Southern Kings Construction Ltd. contrary to the Engineering Profession Act.

Most buildings designed for public use require the services of a professional engineer.

Last September, construction of the hotel was halted after the contractor pled guilty in Charlottetown Provincial Court to charges of engaging in the practice of architecture without a license.

In this case, charges against MacLean were filed by the Architects Association of PEI and were based on the construction plans not being in compliance with the Architects Act of PEI.

MacLean was fined $2,500 by Provincial Court Judge John Douglas fine of $2,500. Under the Architects Act, the charge could have resulted in a fine of up to $5,000, or six months in jail.

Southern Kings Construction Ltd. is a family business that operates from its head office in Montague, which is in the eastern end of PEI.

The company’s website claims that Gold Seal project managers, estimators and site superintendents are employed to undertake a wide variety of residential, commercial, mixed-use, institutional and industrial projects.
